Fresh OCI Card for Adult who earlier held Indian passport

Adults who were previously Indian citizens and have acquired foreign citizenship (except from Pakistan or Bangladesh) are eligible to apply for a fresh Overseas Citizenship of India (OCI) card. While the Constitution of India does not permit dual citizenship, the OCI scheme was introduced by the Government of India to allow Persons of Indian Origin (PIOs) to maintain strong ties with India. The eligibility also extends to spouses of Indian citizens or existing OCI cardholders, provided the marriage has been registered and has lasted for at least two continuous years. The OCI card provides multiple benefits, including a lifelong, multiple-entry visa to India and exemption from police registration regardless of the length of stay. OCI holders enjoy parity with Non-Resident Indians (NRIs) in economic, financial, and educational fields, except in matters related to the acquisition of agricultural or plantation properties. However, they are not granted political rights such as voting, holding public office, or government employment.

FAQs

  1. I used to hold an Indian passport but now I am a foreign citizen. Can I apply for an OCI card?
Yes, you can. If you were once an Indian citizen and now hold foreign citizenship (excluding citizenship from Pakistan or Bangladesh), you're eligible to apply for an OCI card.
  2. What benefits do I get with an OCI card?
With an OCI card, you receive a lifelong visa to enter India, multiple times. You don’t need to register with the police regardless of how long you stay. You also enjoy similar rights to NRIs in areas like property (except agricultural land), education, and financial investments.
  3. Is dual citizenship allowed in India?
India doesn’t allow dual citizenship, but the OCI card gives you many benefits similar to those of Indian citizens, without affecting your current nationality.
  4. Can I apply if my spouse is Indian or holds an OCI card?
Yes, if your spouse is of Indian origin or has an OCI card, and your marriage has lasted at least two years and is officially registered, you're eligible to apply based on that connection.
  5. Do I need to provide my old Indian passport?
If you still have it, including a copy will help. If it’s lost or unavailable, you can submit other documents that show your Indian origin—like an Indian birth certificate, school records, or your parents’ Indian documents.
  6. What if my Indian passport hasn’t been officially cancelled yet?
In that case, you’ll need to submit the original passport, a photo, a copy of your foreign passport and citizenship certificate, your application form, and Form XXII for surrender.
  7. My name has changed since I last held an Indian passport. Will that be a problem?
Not at all. You just need to include a name change certificate or a statutory declaration explaining the change.
  8. What if I’ve lost my Indian passport?
You can still apply. Please include a statutory declaration explaining the loss along with Form XXII.
  9. Do I have to upload any documents online before submission?
Yes, part of the process includes uploading key documents online—like your passport, proof of Indian origin, photograph, and signature—before submitting the hard copies.
  10. How do I sign the application if I’m applying for my child?
Either parent or a legal guardian can sign the form on behalf of a minor. If your child doesn’t sign their passport, just write “No Signature” on a paper and upload that instead.
  11. How do I prove I’m currently living in Australia?
If you are not an Australian citizen, you’ll need to include a copy of your valid Australian visa. Citizens of New Zealand or other countries should also provide a copy of their Medicare card.
